SPRINGFIELD – State Senator Laura Fine has championed a new law to strengthen employee protections by clarifying unlawful labor practices related to workplace harassment and discrimination.
“We can only strengthen Illinois’ workforce and attract new talent when workers are guaranteed a fair and respectful environment,” said Fine (D-Glenview). “Those who experience or witness harassment or discrimination must feel safe and supported when coming forward.”
Building on existing protections against workplace discrimination and harassment, Fine’s law includes crucial safeguards in the workplace by prohibiting employers from imposing unlawful restrictions on their employees through workplace confidentiality agreements.
This law would also require fairly negotiated confidentiality agreements to include a disclaimer regarding an employee’s right to participate in legal proceedings related to illegal employment practices, including their right to engage in activities to address work-related issues. It also enables an employee to collect attorney’s fees and costs associated with a successful defense.
“Employees facing workplace issues like sexual harassment or discrimination should never feel silenced by unjust confidentiality agreements,” said Fine. “This law promotes fair reporting practices and reinforces employers’ responsibility to uphold workers’ rights.”
House Bill 3638 was signed into law Friday and is effective Jan. 1, 2026.
